EXECUTIVE SESSION.

2.I.

Section 551.071 of the Texas Open Meeting Act to meet with its Attorney to seek legal advice on a matter in which the duty of the Attorney to the City Council under the Texas Disciplinary Rules of Professional conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act relating to:

  1. Phase 2 Annexation of Property consisting of up to 1,400 acres of land located North of Aransas Pass and extending up to the City of Rockport's Extraterritorial Jurisdiction, and along Highway 35 Bypass and Highway 35 Business.
2.II.

Consider, discuss and take action on Resolution No. 2019-910 to accept or deny:

(1) each petition filed for inclusion into the Municipal Annexation Plan for Petitioners who reside or own land in the proposed Phase 2 Annexation of Property consisting of up to 1,400 acres of land located North of Aransas Pass and extending up to the City of Rockport’s Extraterritorial Jurisdiction, and along Highway 35 Bypass and Highway 35 Business; and

(2) each Request for Arbitration from requestors who reside or own land in the same proposed Phase 2 Annexation of Property.

Development Agreements in Lieu of Annexation:

  1. Consider, discuss and take action to approve a Development Agreement in lieu of annexation for said property to remain agriculture, wildlife management, or timber ad valorem tax exemption. Said property known as Aransas County Appraisal District Property ID No. 28082 owned by John Eric Stennett commonly known as 1410 S H 35 Bypass, Aransas Pass, Texas bearing a legal description of the South one-half (S/2) of a tract described as the Surface Estate Only of Farm Lots 1, 2, 3, 4, 5, and 6, Block 8, of the T.P. McCampbell Ranch Subdivision, Aransas County, Texas according to plat recorded in Volume 1, page 1 of the Aransas County Book of Maps and Plats.
  2. Consider, discuss and take action to approve a Development Agreement in lieu of annexation for said property to remain agriculture, wildlife management, or timber ad valorem tax exemption. Said property known as Aransas County Appraisal District Property ID No. 28083 owned by Andrea R. Warren commonly known as 1440 S H 35 Bypass, Aransas Pass, Texas bearing a legal description of the North one-half (N/2) of a tract being described as the Surface Estate Only of Farm Lots 1, 2, 3, 4, 5, and 6, Block 8, of the T.P. McCampbell Ranch Subdivision, Aransas County, Texas, according to the plat recorded in Volume 1, page 1 of the Aransas County Book of Maps and Plats.
  3. Consider, discuss and take action to approve a Development Agreement in lieu of annexation for said property to remain agriculture, wildlife management, or timber ad valorem tax exemption. Said property known as Aransas County Appraisal District Property ID No. 59761 owned by Chester A. Kaczenski and Sol B. Kaczenski commonly known as 2050 Johnson Road, Aransas Pass, Texas bearing a legal description of Lots. Three (3) and Four (4), Block No. Ten (10), T.P. McCampbell Subdivision, Aransas County, Texas according to the plat thereof recorded in Volume 1, Pages 3-4, Plat Records, Aransas County, Texas.
  4. Consider, discuss and take action to approve a Development Agreement in lieu of annexation for said property to remain agriculture, wildlife management, or timber ad valorem tax exemption. Said property known as Aransas County Appraisal District Property ID No. 66617 owned by Azar Noosh Mohamadi Revocable Living Trust as Grantor to Grantee Marjan Mohamadi commonly known as 2025-2211 Smith Road, Aransas Pass, Texas bearing a legal description of the Surface Estate Only to 46.061 acres of land embracing a portion of Lot No. Three (3), and all of Lot Nos. Four (4), Five (5), Six (6) and a portion of Lot Nos. Seven (7) and Eight (8), Block No. Eleven (11), T.P. McCampbell Subdivision, Aransas County, Texas, according to the map recorded in Volume 1, Pages 3-4, Plat Records of Aransas County, Texas.
  5. Consider, discuss and take action to approve a Development Agreement in lieu of annexation for said property to remain agriculture, wildlife management, or timber ad valorem tax exemption. Said property known as Aransas County Appraisal District Property ID No. 66618 owned by Azar Noosh Mohamadi Revocable Living Trust as Grantor to Grantee Marjan Mohamadi commonly known as 2190 S H 35 Bypass, Aransas Pass, Texas bearing a legal description of the Surface Estate Only to 41.424 acres of land embracing a portion of Lot No. One (1), All of Lot No. Two (2), a portion of Lots Nos. Three (3), Four (4), Five (5), Six (6), Seven (7) and Eight (8), Block No. Twelve (12), T. P. McCampbell, Aransas County, Texas, according to the map recorded in Volume 1, Pages 3-4, Plat Records of Aransas County, Texas.
  6. Consider, discuss and take action on whether to approve a Development Agreement in lieu of annexation for said property to remain agriculture, wildlife management, or timber ad valorem tax exemption. Said property known as Aransas County Appraisal District Property ID No. 14816 owned by JCACJ Holdings LLC and Christine Foerg Goetz commonly known as 540-860 Longoria Road Unit, Aransas Pass, Texas bearing a legal description being 26.155 acres of land embracing all of Lot No. Three (3), Block No. Two Hundred Thirty-Five (235), Burton and Danforth Subdivision, Aransas County, Texas, according to the Map recorded in Volume 1, Pages 62 and 63, Map Records of Aransas County, Texas.
  7. Consider, discuss and take action on whether to approve a Development Agreement in lieu of annexation for said property to remain agriculture, wildlife management, or timber ad valorem tax exemption. Said property known as Aransas County Appraisal District Property ID No. 69910 owned by Michael R. Deyo, commonly known as 1502 San Antonio Avenue, Aransas Pass, Texas bearing a legal description of Tract 10, C.L. Dignowity Subdivision, Aransas County, Texas according to the Plat thereof recorded in Volume 1, Page 17, Plat Records of Aransas County, Texas.
  8. Consider, discuss and take action on whether to approve a Development Agreement in lieu of annexation for said property to remain agriculture, wildlife management, or timber ad valorem tax exemption. Said property known as Aransas County Appraisal District Property ID No. 66719 owned by Michael R. Deyo, commonly known as 2401 Arena, Aransas Pass, Texas bearing a legal description of the Surface Only Estate in and to Tract Nine (9), D.L. Dignowity Subdivision, Aransas County, Texas according to the Plat there of recorded in Volume 1, Page 17, Plat Records, Aransas County, Texas.
  9. Consider, discuss and take action on whether to approve a Development Agreement in lieu of annexation for said property to remain agriculture, wildlife management, or timber ad valorem tax exemption. Said property known as Aransas County Appraisal District Property ID No. 17414 owned by Charles Roark, commonly known as 1101 San Antonio Avenue, Aransas Pass, Texas bearing a legal description of Dignowity, Lot 3, Acres 10, Aransas County, Texas.
  10. Consider, discuss and take action on whether to approve a Development Agreement in lieu of annexation for said property to remain agriculture, wildlife management, or timber ad valorem tax exemption. Said property known as Aransas County Appraisal District Property ID No. 69909 owned by Charles Roark, commonly known as 1202 San Antonio Avenue, Aransas Pass, Texas bearing a legal description of Dignowity, Lot 12-13, Acres 20, Aransas County, Texas.
  11. Consider, discuss and take action on whether to approve a Development Agreement in lieu of annexation for said property to remain agriculture, wildlife management, or timber ad valorem tax exemption. Said property known as Aransas County Appraisal District Property ID No. 8809949 owned by Dolores Mooers Trust, Moores Oil Corporation, Heater M. Dolores Moores, Skycliff, LLC c/o Michele Sturtevant, and  Charles Roark, commonly known as 1601 San Antonio Avenue, Aransas Pass, Texas bearing a legal description of Dignowity, Lot 8, Acres 9.30, Aransas County, Texas.
  12. Consider, discuss and take action on whether to approve a Development Agreement in lieu of annexation for said property to remain agriculture, wildlife management, or timber ad valorem tax exemption. Said property known as Aransas County Appraisal District Property ID No. 8809950 owned by Charles Roark, Marsha D. Ratliff, Bailey Ratliff III, Clifford D. Patterson, Ray Kent Patterson and John Eric Patterson commonly known as 1102 San Antonio Avenue, Aransas Pass, Texas bearing a legal description of 10 acres, more or less, and more particularly described as being Farm Lot Number Fourteen (14) out of the Dignowity Subdivision of the Elizabeth Talley Survey, according to the official map of said subdivision as shown of record in the office of the Aransas County Clerk, Aransas County, Texas, in Book or Volume 2, Page 17 of the Map or Plat Records, to which reference is here made for all pertinent purposes.

Adoption of Phase 2 Annexation of up to 1,400 acres of land located North of Aransas Pass and extending up to the City of Rockport's extraterritorial jurisdiction and along Highway 35 Bypass and Highway 35 Business:

Consider, discuss and take action to adopt Ordinance No. 2019-4255 to annex for full purposes up to 1,400 acres of land into the territorial limits of the City of Aransas Pass and extending the boundary limits of said city to include said hereinafter described property within said city limits and granting to all the inhabitants of the property all the rights and privileges of other citizens and binding the inhabitants by all of the ordinances, resolutions, acts and regulations of the City; Adopting a Service Plan; Finding and determining that all requirements for annexation include public hearings, notices and open meetings have been met according to law; proving instruction for filing this Ordinance and for correcting the Official Map and boundaries of said City; Providing severability and cumulative clauses; and providing an effective date.

Consider and Act on setting public hearings on the Ad Valorem Tax Rate for September 3, 2019 and September 9, 2019 during the City Council Meetings beginning at 6:00 PM at City Hall, 600 W. Cleveland, Aransas Pass, Texas.

Consider and Act on setting September 16, 2019 as the date of adoption of the Ad Valorem Tax Rate up to $0.799194 per $100 valuation.
